This Privacy Policy sets out the types of personal information (“Personal Data”) we may collect from you through our website, mobile application, physical stores, kiosks, customer touchpoints and any other platform owned and/or operated by us (collectively referred to as the “Platform”), and the manner in which such data is used, stored, processed, and disclosed to third parties, including service providers, regulators, and intermediaries in compliance with SEBI regulations and the Digital Personal Data Protection Act, 2023 (“DPDP Act”)
This Privacy Policy also identifies the rights and options available to you with respect to your Personal Data and the manner in which you may reach out to us should you have any concerns or queries regarding this Privacy Policy
We are committed to safeguarding your Personal Data through Reasonable Security Practices and Procedures in accordance with Applicable Laws. Should you choose to provide and thereafter not to continue providing us with the consent for the requested Personal Data, we will be unable to offer you, our Services
You are advised to carefully read the Privacy Policy before using this or any other platform, application or channels for communicating with us or sharing information or Data (including any Personal Data) with us or our Representatives, or prior to using the Services. We shall not be liable / responsible for any breach of privacy owing to the User’s negligence. We are only responsible for the privacy practices and security of the Platform. Definitions
(a) Affiliate(s)" shall mean with respect to AMC, any person directly or indirectly controlling, controlled by, or under direct or indirect common control with AMC including its subsidiaries and associate companies
(b) Applicable Laws means all provisions of laws, statutes, ordinances, rules, regulations, permits, certificates, judgments, decisions, decrees or orders of any governmental authority applicable to a Person and includes:
● The Digital Personal Data Protection Act, 2023 (as applicable)
● The Securities and Exchange Board of India (Mutual Funds) Regulations, 1996
● The Prevention of Money Laundering Act, 2002 and the rules and guidelines issued thereunder
● SEBI circulars, operational guidelines, and cybersecurity frameworks applicable to mutual funds and Asset Management Companies
● The Information Technology Act, 2000
● The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011; each as amended from time to time
(c) Body Corporate means any company and includes a firm, sole proprietorship or other association of individuals engaged in commercial or professional activities
(d) Cookies means a small file placed on your device by our website or mobile application when you either visit or use certain features of our website or mobile application, which allows a website or application to remember your actions or preference for a certain period of time
(e) Data means and includes any representation of information, knowledge, facts, concepts or instructions which are being prepared or have been prepared in a formalized manner, and is intended to be processed, is being processed or has been processed in a computer system or computer network, and may be in any form (including computer printouts, magnetic or optical storage media, punched cards, punched tapes) or electronic records stored in computer memory and include any personal, transactional, or financial information pertaining to an investor, client, or User that is collected, processed, stored, or transferred by the AMC or its authorized service providers in accordance with the Applicable Law
(f) KYC shall mean Know Your Customer
(g) Partners means select third parties with whom we may have contracts for the businesses and facilitating the Services described in this Privacy Policy
(h) Person shall mean any natural person, company, corporation, partnership, proprietorship, trust, union, association, government or any agency thereof or any other entity that may be treated as a person under applicable law
(i) Personal Data shall have the same meaning as that under Applicable Laws and shall include any information that relates to a natural person which, either directly or indirectly, in combination with other information available or likely to be available with a Body Corporate, is capable of identifying such person, as further described in Paragraph 4 below
(j) Platform means the website, mobile application, physical branches, customer touchpoints and any other platform owned and/or operated by the AMC
(k) SEBI shall mean the Securities and Exchange Board of India
(l) Reasonable Security Practices and Procedures means security practices and procedures designed to protect such information from unauthorized access, damage, use, modification, disclosure or impairment, as may be specified in an agreement between the parties or as may be specified in any law for the time being in force and in the absence of such agreement or any law, such reasonable security practices and procedures, as may be prescribed by the Central Government in consultation with such professional bodies or associations as it may deem fit
(m) Regulated Entities or REs means entities that are registered with and regulated by the SEBI under applicable laws, including but not limited to Asset Management Companies (AMCs), mutual funds, custodians, registrars and transfer agents (RTAs), KYC Registration Agencies (KRAs), and depositories, which are governed by the SEBI (Mutual Funds) Regulations, 1996, the Prevention of Money Laundering Act, 2002, and such other circulars, guidelines, or directives issued by SEBI or any other competent authority from time to time
(n) Representatives means the personnel employed or otherwise engaged by the AMC or the group entities for the purpose of their respective businesses
(o) Services shall mean the investment-related services as provided for in the Terms and Conditions of the Platform, including but not limited to the onboarding of investors, facilitation of mutual fund transactions such as subscriptions, redemptions, and switches, portfolio reporting, folio servicing, and investor communications. Services also include tools or features provided through the Platform that allow users to view, monitor, and manage their mutual fund investments, access scheme-related documents, manage their personal details, place non- commercial transaction request including change of bank account in the folio(s), nomination facility, receive regulatory disclosures, and engage with investor education or digital assistance modules offered by the AMC from time to time in accordance with applicable SEBI regulations
(p) User or you shall mean any natural or legal person who accesses or uses the Platform and in the event that a natural person is representing a business entity or a body corporate, reference to such terms shall include a reference to such business entity and / or body corporate as well and other promoters of such business entity and / or body corporate. All references to “you” shall include yourself and any other persons you are authorised to and required to provide consent for
What data do we collect from you?
We collect, transmit, and store personal data about you after obtaining your consent, to provide you with, or in connection with, our Services. Please note that we only collect and process Personal Data in a need-based manner to provide you with the Services. Such Personal Data includes:
(a) Identity and profile-related information: This encompasses information such as your first, middle and last name, username or similar identifiers, gender, title, photos, educational qualifications, location and employment details. This information helps us in the creation of your profile, undertaking KYC, assessing your eligibility for a loan and provide you with customised support in case of issues
(b) Contact information: This includes your email addresses, phone numbers, and residential address. With your consent, we may also gather and store information about individuals in your contact list with whom you would like to share certain transactions
(c) KYC information: This includes government-issued officially valid documents such as PAN card, voter ID, Goods and Services Tax (“GST”) details, ration card, voter identification card, Aadhaar card, driver’s license, Udhyam information, etc. and any other document prescribed under the Applicable Laws from time to time. These accesses are for the purpose of on-boarding / KYC requirements. We ensure that your Aadhaar card is stored in a manner specified under Applicable Law
(d) Transaction information: This comprises details of transactions that occur through the Platform or are related to the Services. For instance, it may include services you've requested or confirmed through the Platform
(e) Data from SMSs: With your consent, we collect, transmit, and store SMS data from your phone to assess your financial situation, analyze cash flow, credits, income, and spending patterns
(f) Financial data: This encompasses your income information, and payment details, bank account information, income tax returns information, salaries, bank statements, investments, applications, any related purposes through which services are provided to the investors, etc
(g) Marketing and communications data: This includes your preferences regarding marketing messages from us and third parties, as well as your communication preferences. We may use third-party advertising companies to serve advertisements when you visit our Platform. These companies may use information about your usage preferences and about your visits to this and other websites in order to provide advertisements about goods and services that may interest you. In the event you choose to interact with their advertisements and are redirected to their websites, you will be complying with their respective terms and conditions. AMC will not be responsible for product and services of such websites and is also not responsible for their privacy practices, as AMC does not own, manage or control such websites
(h) Device data: This involves IP addresses, browser types, time zone settings, operating systems, and device information. We securely collect, transmit, and store this data on our server. We do not access your mobile phone resources such as call logs, telephony functions, and files & media except for the purpose of on-boarding you as our customer and / or for KYC requirements. We do not collect your biometric data. However, we may access your camera, microphone, location (fine and coarse GPS data), or any other facility solely for the purpose of onboarding or KYC checks, after obtaining your explicit consent
(i) Usage data: This consists of information about how you use our Platform. We collect information about your device to provide automatic updates and additional security so that your account is not used in other people’s devices. In addition, the information provides us valuable feedback on your identity as a device holder as well as your device behavior, thereby allowing us to improve our products interaction, quality of services and provide a personalized user experience to you
(j) App data: We collect, transmit, and store information about installed applications. Specifically, we use the package name of each installed application to assess creditworthiness and provide personalized offers for various financial services like loans, insurance, mutual funds etc. This data also aids in research and marketing efforts
(k) Data from Affiliates: AMC will have arrangements from time to time with Affiliates of AMC to jointly develop and run statistical models based on the customer information available with such Affiliates. We may collect information & data which such Affiliates have collected from you from time to time
We may supplement the information that you provide, with other information that we obtain from our dealings with you or which we receive from other organizations, for example Partners, and other companies of the Affiliate group
You are requested to provide AMC with accurate and complete Personal Data in order to avail our Services. We request that any change to your Personal Data be communicated to us, for us to service you better
How and when do you consent to usage and sharing of your data?
(a) AMC only collects Data from Users in accordance with the explicit consents obtained from such Users and after informing them about the consequences of refusing to provide Personal Data or withdrawing consent for the identified purposes
(b) AMC maintains an auditable record of such consents granted, modified or withdrawn
(c) This Privacy Policy also covers the terms of the consents granted by you to AMC for the Personal Data submitted by you
(d) All information provided by you (including Personal Data) is purely voluntary
(e) You may also withdraw or modify your consent to collect / provide / share / process the information (including your Personal Data) by communicating to the email ID given below in writing. However, in such instance, (i) you may not be able to access some or all of the features or pages of the digital platform / applications; (ii) you may not be able to avail some or all of our Services; or (iii) if you have already availed our Services, such Services may be withdrawn, curtailed or canceled as per the terms thereof upon such withdrawal or modification of consent
(f) In some cases, it is essential for the information (including your Personal Data) to be collected / retained / stored / processed / shared either regulatorily, or as a matter of policy or for any of the purposes above and you are requested not to avail the Services if you do not wish to provide such information or provide consent to collect / share / process the same. For any queries in this regard, you may contact the email IDs mentioned in paragraph 20 of this document
(g) AMC ensures that an appropriate data privacy commitment is provided to the Users and their express consent for seeking, collecting, storing, utilizing and sharing their Personal Data is obtained at the time of or before collecting their Personal Data including any sensitive Personal Data either by the terms of this Privacy Policy or otherwise
(h) AMC would collect your Data for competitions or marketing surveys or from publicly available sources in accordance with Applicable Laws
(i) Any information collected is stored in secure databases protected via a variety of access controls and is treated as confidential information by AMC. You should be careful with usage of your username and password by maintaining confidentiality and ensure that you do not knowingly or accidentally share, provide and facilitate unauthorized use of it
(j) We may also obtain your Data from independent third parties, as governed by their respective privacy policies, including our, Partners, payment partners, technology providers, e-commerce platforms, payment aggregators, payments systems, payment service providers and financial institutions, fraud prevention agencies, independent service providers and Affiliates etc
(k) We may process your information including Personal Data as a financial information user with your consent, including information collected through recognised account aggregator(s)/consent manager, in accordance with Applicable Law to provide you with our Services
(l) The AMC may appoint third-party service providers, including affiliates or entities within the group entities, to carry out specific outsourced functions. Such support services may include investor servicing, transaction processing, data analytics, technology platform management, cybersecurity operations, and other information technology services
(m) We may obtain your data that may be available with group entities/partners of AMC and lodge a copy of your consent with such group company/partner, for the purposes as mentioned in clause 7 hereinafter
How and where do we collect and store your data?
(a) When you download our mobile applications, sign up with us for an online account, register to receive marketing communications from us, fill in one of our forms (whether online or offline), contact us or otherwise expressly provide us with your Personal Data, we may collect and store any Personal Data that you provide to us and may use it to personalize and improve your experience on our digital platforms, provide Services you request from us, and carry out profiling and market research
(b) We may also collect your Personal Data through your conversations (telephonic or otherwise) with the Representatives or any of AMC’s customer service agents and / or any other mode of communication or submitted by you vide documents, images or in any other form and whether in the physical or digital / online mode. You agree that any such communication whether written or oral may be recorded to comply with AMC’s internal processes or any Applicable Laws
(c) We use Cookies, cache pixels and similar technologies to receive and store certain types of information of the User. This information helps us to make improvements to our content and helps us provide you a better navigation experience on our platforms. Our backend servers and / or Partners who provide analytic services, collect inter alia IP addresses, operating system details, browsing details, device details and language settings. This information is processed to inter alia estimate the number of visits, average time spent on our platforms, and nature of pages viewed
(d) When you access third-party websites or app with whom we have contractual agreements, the applicable website operators’ privacy policies would apply and is not covered by our Privacy Policy. In such an event, we may also receive such Personal Data used by the relevant third-party websites to identify your account with such website
(e) In order to facilitate the Services to you, we may receive certain information pertaining to document verification, repayment status etc. from certain third parties including National Securities Depository Limited (“NSDL”) and payment gateway providers
(f) We may further collect your GST details from authorised governmental institutions
(g) The Personal Data collected from you is stored at our backend servers and cloud servers situated in India
(h) We shall only collect the above-mentioned information on a need basis strictly for the purpose of providing you with the Services
What do we use your data for?
In broad terms, we use your Personal Data for the following purposes:
(a) Creating your account with us and onboarding you as a user
(b) Establishing and verifying your identity for KYC including but not limited to ourselves as well as our, Affiliates
(c) Administer and provide Services you request or have expressed an interest in through us or our Partners
(d) Communicate with you in the event that any Services you have requested are unavailable
(e) Internal risk assessments and analysis
(f) For fraud / Anti Money Laundering (AML) / name screening and prevention purposes and to protect ’s legal rights and compliance with AMC’s legal obligations, in a manner prescribed under our board approved Fraud Risk Management and KYC/AML/Combating of Financing of Terrorism (CFT) Policy
(g) For record keeping purposes, to comply with laws and regulations as may become applicable from time to time, and to comply with other legal processes and law enforcement requirements
(h) To carry out market research so that we can improve the Services we offer
(i) To track your activities and engagement on our digital platforms
(j) To create an individual profile for you so that we can understand and respect your preferences
(k) To personalize and improve your experience on our digital platforms and allow you to utilize our digital platforms’ features by granting AMC access to information from your device
(l) To personalize and / or tailor any communications that we may send you
(m) To enable us to personalize and / or tailor any marketing communications that you may consent to receive from us
(n) To inform you about important details like AMC’s digital platforms, change in terms, conditions and policies and / or other administrative information important to meet your interests
(o) To address your requests, feedback and queries and manage your relationship with AMC .
(p) To assess your eligibility for our Services and provide you with such Services which you may have shown interest in or requested for
(q) To perform activities such as data analysis, audits, usage trends to determine the effectiveness of AMC’s campaigns and as input into improving Services.
(r) For security, business continuity and risk management.
(s) For system or product development and planning, audit and administrative purposes.
(t) To carry out our obligations arising from any contract entered into between you and us.
(u) providing you with offers (including for financial products and/or services), personalized services and recommendations;
(v) to inform you about loyalty programs or other offers owned and operated by us.
(w) To ensure continued relationship with our customers, Partners or suppliers.
(x) To help investigate violations of our terms of use or to defend against legal claims.
(y) To disclose the information under special circumstances such as compliance with the applicable local law, court summons, court orders, requests / order from legal authorities or law enforcement agencies requiring such disclosure.
(z) To meet the legitimate interests to be pursued by AMC or by a third party.
(aa) for analytics and measurement to determine your preference and usage of services/ products of AMC and for creating products or services that may meet your needs.
(bb) for generating aggregated data, either directly or through partners and/or group entities of AMC to prepare insights to enable AMC to understand your preference, patterns and trends with a view to learning more about your preferences or other characteristics.
Whom do we share your Personal Data with?
(a) AMC may share your information (including the Personal Data) with third parties including but not limited to Registrar and transfer agents, call centres, fund accountant, local and international couriers, , its Affiliates, vendors, service providers, data processors, banks, financial institutions, , Central KYC Registry, investigating authorities, law enforcement agencies, telecommunication companies, and statutory bodies for customer verification, personalization of Services, credit rating, data enrichment, marketing or promotion of the Services of AMC, its or of any other service provider.
(b) AMC may share your information including the Personal Data as a financial information provider with your consent collected through recognised account aggregator(s)/consent manager(s), in accordance with Applicable Law.
(c) We may share the following with any third party including duly appointed partners, service providers, associates and Affiliates of JFL: (a) any data submitted by you to AMC; (b) any data arising out of your contractual relationship with AMC; (c) any incremental data/insights generated by processing/analysing of the data specified in sub-clause (a) or (b) herein or any combination thereof.
(d) AMC may share such information in the course of normal business operations, such as providing services you have subscribed to, and any activity related to these services such as collection of fees, enrolling you for additional services and benefits
(e) It may become necessary for AMC to disclose your Personal Data to its agents and contractors in the course of normal business operations for the above referred purpose. However, these parties would be required to use the information obtained from AMC for such purposes exclusively.
(f) The third parties with whom your Personal Data is shared shall be required to only process such Personal Data in accordance with express instructions and as necessary to perform Services for purposes set forth in this Privacy Policy. Such third parties shall also be required to safeguard the security and confidentiality of the Personal Data they access and process by implementing appropriate technical and organizational security measures and confidentiality obligations.
(g) AMC shall undertake all Reasonable Security Practices and Procedures prescribed under Applicable Laws to ensure that the confidentiality of your information (including your Personal Data) is maintained by third parties to whom it discloses such information.
(h) AMC may be required to disclose your Personal Data to statutory authorities or other persons in connection with any legal process that may be initiated by such authorities in accordance with Applicable Laws, or for any risk mitigations purposes undertaken by us. However, this does not include selling or otherwise disclosing your Personal Data for commercial purposes in violation of this Privacy Policy and Applicable Laws.
(i) It should be noted that other group entities as well as our Partners may have privacy practices and policies that differ from those of AMC. The use of your Personal Data will be governed by their respective privacy statements when you provide your data and other information on their websites and / or applications.
(j) We shall disclose your KYC data to the relevant regulatory authorities as a part of our statutory audit process. In the event that your Aadhaar number has been collected in a manner specified under sections 4.1(c) or 4.1(d) above, it shall only be disclosed in a manner specified in Applicable Laws.
(k) AMC may also invite visitors to our website to participate in market research and surveys and other similar activities.
(l) AMC reserves the right to communicate your Personal Data to any third party for compliance with a court order, judgment or statutory mandate or statutory investigation or makes a legally compliant request for disclosure.
(m) In the event we buy or acquire other businesses from third parties, or sell our business (or any verticals thereunder, by whatever name called) to a third party, or otherwise take actions to develop and grow our business, the Personal Data collected by us may be shared with third parties and / or statutory authorities in such instances.
(n) If you choose to utilize the Services offered by us, our Partners, we may share your Personal Data with such Partners. Such Partners will be required to maintain the privacy of such Personal Data in accordance with this Privacy Policy as well as per the Applicable Laws.
(o) Your consent is sought by way of this Privacy Policy in order for us to share the Personal Data as described above. By accepting the terms of this Privacy Policy, you provide your consent to that effect.
(p) You acknowledge that the Platform has duly collected the information with your consent, and you have the option to not provide such information or deny consent for use of specific information or revoke the consent already given. However, any withdrawal of such Personal Data will not be permitted if any Service availed by you is active. Where consent has been withdrawn the Platform does not guarantee or be liable for providing such Service.
How long do we retain your Personal Data?
(a) AMC shall not retain any Personal Data longer than permissible under Applicable Laws.
(b) Your Personal Data may however be retained for a longer period where we need such information for legal, regulatory, accounting, processing or other legitimate purposes which may include but not be limited to filing / addressing complaints, responding to any queries raised by any of our regulators / customers / governmental bodies and defending any legal claims.
(c) To determine the appropriate retention period for Personal Data, AMC considers the amount, nature and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which it processes your Personal Data, and whether it can achieve those purposes through other means, and the applicable legal requirements.
(d) The User must note that different data types and purposes necessitate varying retention periods and therefore the length of retention of their Personal Data (depending on the nature thereof) may vary significantly.
(e) In some circumstances, AMC may anonymize your Personal Data so that it can no longer be associated with you and use such information.
(f) Upon your written request sent at the email IDs set out below, to the effect of requesting us to delete all your Personal Data, we will undertake all reasonable actions, legally mandated to us as per Applicable Laws, to delete and no longer store your Personal Data with us. The User must however note that by previously consenting to the sharing of the Personal Data (including to third parties), the User has made itself aware that AMC may not be able to enforce such deletion request upon such varied third parties and is not responsible nor liable for the deletion of your Personal Data by such third parties.
How do we safeguard your Personal Data?
(a) We require the third parties we engage with for the purposes of our business, by contract or otherwise, to only process your Personal Data shared with them in accordance with our instructions and as necessary to perform services on our behalf or in compliance with Applicable Laws.
(b) We also require such third parties to safeguard the security and confidentiality of such Personal Data to which they receive access, by implementing sound, appropriate and adequate confidentiality, technical and organizational security measures. The User however must note that AMC cannot personally ensure compliance of these measures by the third parties, and therefore cannot be held liable for breach of such requirements at the level of such third parties to the extent permissible by Applicable Laws.
(c) AMC uses procedural and technical safeguards to secure your Personal Data from unauthorized access and use, alteration and destruction.
(d) In addition, access to your Personal Data is limited to only those Representatives, agents, contractors and other third parties who have a need-to-know. They will only process your Personal Data on AMC’s instructions and are subject to a duty of confidentiality.
(e) AMC will protect your Personal Data against unauthorized use, dissemination or publication in the same manner in which AMC would protect its confidential information of like nature, all in compliance with applicable laws.
(f) We shall use technical, organizational and industry appropriate measures (including measures to deal with any data breach) to safeguard your Personal Data. If you suspect any misuse or loss or unauthorized access to your Personal Data, please let us know immediately by contacting us by e-mail on the IDs set out below.
(g) The AMC aims to protect and secure the information provided by you and uses 128-bit encryption, where applicable, for transmitting information, which is currently the permitted level of encryption in India.
What are your privacy rights and how can you exercise them?
(a) We provide you with reasonable access to view and review your Personal Data and request correction and deletion where appropriate. In order to protect your privacy, we will take reasonable steps to verify your identity before granting access to your Personal Data. When we process your Personal Data, we do so with your consent.
(b) You can choose not to receive marketing emails from us by clicking on the unsubscribe link in any marketing email.
(c) You can make choices about our collection and use of your Personal Data including by requesting to access, correct, complete or erase your Personal Data on our website or mobile application. You also have the right to seek the following information:
● A summary of personal data which is being processed by us and the processing activities undertaken by us with respect to such Personal Data;
● The identities of all other entities with whom the Personal Data has been shared by us, along with a description of the Personal Data so shared; and any other information as prescribed under Applicable Laws.
(d) When you are asked to provide Personal Data, you may choose to decline. You may also withdraw your consent previously provided at any point in time. However, declining to give consent or withdrawing consent may affect the Services. Withdrawal of consent with respect to any Personal Data shared within any Partners will be governed by their respective Privacy Policies.
(e) You may choose to opt out of collection or use of your Personal Data, including the use of Cookies, cache, pixels and similar technologies and the use of your Personal Data for marketing and / or other purposes.
(f) You may also request that your Personal Data is rectified, modified, edited, restricted or request its deletion or anonymization, subject to Applicable Laws and Regulations. In the event we are unable to service your requests of the above nature (owing to regulatory obligations, or otherwise), we will provide you with a reasoned response in such a case.
(g) You may also nominate, any other individual, who shall, in the event of your death or incapacity, exercise your rights in accordance with Applicable Laws. This right may be exercised by contacting us at our customer care number mentioned in paragraph 20.
(h) You also have the right to file complaint to the relevant regulatory authorities in connection with the protection of your Personal Data, details thereof will be made available post notification by the Government.
Your representations to us
You represent to us that you are above the age of 18 and are in contracting capacity to access our platform and share your Personal Data with us.
Offers and opportunities from us and our Partners
We want you to be the first to know about new Services, and occasional offers from our Partners. We may share these offers with you only with your prior consent.
